(Inter)national dispute resolution

Dispute resolution

BMDW Advocaten deals with, among other things, dispute resolution within Football. This includes, for example, disputes regarding transfers, training fees, solidarity contributions, resale clauses or commissions. But it can also involve an employment law issue, such as the dismissal of a Football coach. Although we always first try to resolve a dispute by amicable agreement, we do not shy away from litigation.

Procedures

The lawyers at BMDW Advocaten are regularly involved in (high-profile) legal proceedings related to Football. This is sometimes before the 'ordinary' court, but even more often it involves arbitration proceedings at the KNVB, the FIFA Dispute Resolution Chamber (DRC) or the Court of Arbitration for Sport (CAS).

We can act in these proceedings on behalf of all kinds of parties active in Football. These include players, trainers and coaches, Football clubs, Football agents, scouts and sponsors. Below are concrete examples of the matters we can do for you.

Examples

  • Advising and litigating the dismissal of players, a coach or administrator.
  • Claiming fulfillment of sponsorship agreements in legal proceedings.
  • Litigating with the KNVB over the termination of an employment contract with a club.
  • Legal support in arbitration proceedings over a contract with a sponsor.
  • Litigate with the arbitration board of the KNVB over termination of employment.
  • Ensuring that clubs comply with their contractual obligations, such as paying out bonuses.
  • Resolving disputes between agents.
