How do we work?

Our broad international network and our experience in representing a wide range of (sports-related) clients in various capacities enables us to solve problems and disputes in a thorough, incisive and neat manner. Of course, we do so in consultation with you. After all, it is your case and it is your interests that we represent.

Rates

In principle, BMDW Lawyers works on an hourly rate basis. We charge a fee for our specialist services that is very common in the market and depends on the importance of the case and the required speed of action. Transparency regarding attorney fees is important to us. Therefore, we do not work with "hidden" office costs on top of the hourly rate and in principle we provide a monthly overview of the hours worked and the associated costs.

Fixed fees

Because of the rules of the Bar Association, no-cure-no-pay agreements are generally prohibited. However, fixed fee agreements are possible. As a firm, we are happy to work with you on this type of agreement if the need arises, whereby we can also examine on a case-by-case basis whether a fixed fee in combination with a success fee is workable. Please feel free to contact us to discuss the possibilities.

Legal subscription

We would be happy to discuss with you the possibilities of a 'legal subscription' with BMDW Advocaten. You pay a fixed (monthly) amount and we perform (certain) legal activities. In practice, this lowers the threshold for our clients to call us with legal questions, we get involved in matters more quickly and we can thus take matters in the right direction immediately and nip problems in the bud.

Addition

At BMDW Advocaten you can also get legal aid on the basis of an addition (financed legal aid), even as a sportsman. Whether you qualify for legal aid depends on the type of case and your income. We can apply for legal aid for you, but the Legal Aid Board will ultimately decide whether you qualify for legal aid. If so, you will only pay a contribution. BMDW Advocaten also participates in the Whistleblowers Subsidy Scheme.

Conflict of interest

Because of our position within the industry, the possibility of a so-called "conflict of interest" exists. This may be the case because one of the lawyers has acted for a counterparty in the past. The lawyers are extremely alert to this and act in accordance with the firm's internal policy protocol. If a 'conflict of interest' is detected, the lawyer in question will immediately take the necessary action towards the parties involved, in accordance with the regulations of the Bar Association. Subsequently, it may be the case that parties do not object explicitly (and in writing), in the knowledge that the office, through our network, is more likely to be able to resolve (threatening) conflicts quickly and nip them in the bud, also because the parties involved are usually familiar with (the expertise of) the office.

Other

BMDW Advocaten complies, as a matter of course, with all laws and regulations applicable to lawyers. For example, we strictly comply with the Money Laundering and Terrorist Financing (Prevention) Act (Wwft) and the applicable privacy legislation (including the AVG). In the context of your privacy, we also refer to our firm's Privacy Statement.

The services provided by BMDW Advocaten are also subject to the General Terms and Conditions and BMDW Advocaten has a complaints procedure. If you cannot agree with the settlement of a complaint, you may contact the Disputes Committee for the Legal Profession (Postbus 90600, 2509 LP in The Hague).
