
After pronouncing dissolution of the employment contract between Fortuna Sittard and Sunday Oliseh in its ruling on April 5 last due to a disturbed working relationship, which permanently prevented Oliseh from returning to his position, the Arbitration Committee of the KNVB has also ruled in favor of the club in a second procedure against the coach.
In the proceedings, Oliseh argued that he was entitled to a €100,000 "promotion bonus" due to the fact that Fortuna was promoted to the Eredivisie last season and the bonus was unconditional in his contract.
Fortuna argued that it had already been established in the April 5 arbitration award that Oliseh was not entitled to this bonus, in part because of the previously established culpable actions on his part in creating the disrupted working relationship. The Arbitration Council fully endorsed this position, rejected Oliseh's new claim and ordered him to pay the legal costs.
In both proceedings, Fortuna was assisted by BMDW Partner Frans de Weger.
